9/11/06 It's Official: Constitutional TEL is Dead
The Ballot Board has approved the initiatives that will appear on Ohio 's November ballot, and the previously-proposed Tax and Expenditure Limitation constitutional amendment was not among the approved ballot measures. August 24 was the deadline for submission of issues to be considered and the TEL amendment was not submitted, per the agreement between the Ohio General Assembly and the supporters of the amendment, including gubernatorial candidate Ken Blackwell. HB 312, the legislature's version of the TEL, became effective on August 21 so the withdrawal letter filed by the committee supporting the TEL was effective on that date. Given that no one has filed a lawsuit to challenge the constitutionally of the withdrawal or a mandamus against the Secretary of State to require him to certify the issue, TEL is officially dead.
